For example, if you share your name and contact information to ask a question about our products or services, we will use that personal information to respond to your inquiry. Similarly, if you share your name, email address, and zip code as part of a Pet Profile, we will use that personal information to set up your Pet Profile. Also, if you share your information to enter a contest sponsored by us, we will use such information in connection with running the contest.
- To provide, support, personalize, and develop our Services, products, and services.
- Helping maintain the safety, security, and integrity of our Services, products and services, databases and other technology assets, and business.
- Testing, research, analysis, and product development, including developing and improving our Website, products, and services.
- Responding to law enforcement requests and as required by applicable law, court order, or governmental regulations.

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. Once we receive a and confirm your verifiable consumer request (see Exercising Access, Data Portability, Correction, and Deletion Rights), we will use commercially reasonable efforts to correct the information to comply with your request. Not all state privacy laws may afford this right to their residents.
Deletion Request Rights
You may have the right to request that we delete your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, Correction, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information , unless an exception applies.
We may deny your deletion request if retaining the personal information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

Personal Information Sales and Sharing Opt-Out and Opt-In Rights.
Pursuant to applicable law, you have the right to direct us to not sell or share your personal information at any time (the “right to opt-out”). As used herein, “share” refers to sharing for purposes of cross-context behavioral advertising or targeted advertising, as contemplated under applicable law.
We do not have actual knowledge that we sell or share the personal information of individuals under 16 years of age. We will not sell or share the personal information of individuals we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the individual who is between 13 and 16 years of age, or the parent or guardian of an individual less than 13 years of age. Individuals who opt-in to personal information sales or sharing may opt-out of future sales or sharing at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales or sharing. You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
Please note that if you visit our website with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt-out for the device and browser that you use to visit the website. If we are able to associate the device sending the signal to a Shopify account, we will apply the opt out request to the account as well. Exercising Access, Data Portability, Correction, and Deletion Rights
To exercise the access, data portability, correct, and deletion rights described above, please submit a verifiable consumer request to us by either:

When you use a request method above, we will request certain information for verification purposes, such as your name, address, and e-mail address. We will use this information to verify this is a permitted request, such as by matching your name and address with information in our records. Depending on the type of request, we may require a certain number of data points to allow for verification.
Only you, or a person properly authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you use an authorized representative to submit a consumer request, we may require the authorized representative to provide proof that you gave the representative signed permission to submit the request. We may also require you to verify your own identity directly with us or directly confirm with us that you provided the authorized representative permission to submit the request.
The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
If we deny your request, you may have the right to appeal our decision. Further, if you appeal and your appeal is denied, you may have the right to complain to your state’s attorney general. You may appeal your decision by contacting us at cservice@instinctpetfood.com.
Response Timing and Format
We will confirm receipt of your request within ten (10) business days of receipt or within such other period permitted by applicable law. We endeavor to respond to a verifiable consumer request within 45 calendar days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
You may make a consumer request for access or data portability free of charge twice within a 12-month period. Additional requests may be subject to a fee. We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We will not discriminate against you for exercising any of your rights under law. Unless permitted by applicable law, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by applicable law that can result in different prices, rates, or quality levels. Any legally-permitted financial incentive we offer will reasonably relate to the value to us of your personal information and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Limitations of Medical Information
The material available on all our Services is, without limitation, provided for informational and educational purposes only; it is not intended to take the place of advice from a licensed, practicing veterinarian. Authorized Resale Policy
M.I. Industries, Incorporated dba Instinct Pet Food (“Instinct”) hereby adopts this Resale Policy (this “Policy”) and requires that each person, firm or entity (as applicable, a “Reseller”) that purchases Instinct’s products (the “Products”) for resale or other distribution agree to comply with this Policy.
All Resellers must contact Instinct to seek authorization to resell the Products and execute an Instinct Authorized Reseller Agreement, if authorized by Instinct in Instinct’s sole discretion. Any Reseller that fails to execute an Instinct Authorized Reseller Agreement and comply with this Policy will be deemed an unauthorized reseller of the Products. Instinct does not grant any unauthorized reseller any right to: (i) sell the Products; (ii) use Instinct’s intellectual property, including any of its trademarks or copyrights; or (iii) offer Instinct’s consumer warranty applicable to any of the Products.
- Applicability. This Policy applies to all resales of the Products. Regardless as to where the Products were acquired, either directly from the Instinct, through an authorized distributor, or some other procurement method, a Reseller must comply with the terms of this Policy.
- Sales to End Users Only. Unless otherwise agreed with Instinct in writing, Reseller may only purchase Products for resale to consumers and end user customers, and Reseller may not resell Products to other Resellers, distributors or for further distribution in any manner.
- No Sales on Online Marketplaces. Without the Instinct’s express written consent, Reseller may not utilize Instinct’s trademarks or copyrights to advertise or sell the Products online on any e-commerce platform, specifically including, but not limited to, Amazon, eBay and Walmart. An authorized Reseller may sell Products on its own website so long as the Reseller complies with the terms of this Policy and any agreed contract terms at all times.
- Handling and Storage. Reseller agrees to handle and store the Products in a safe manner and in compliance with Instinct’s storage and handling guidelines, as made available from Instinct from time to time. Reseller will ensure that any Products it purchased are stored in secure, climate-controlled warehouses. Reseller agrees to grant Instinct inspection and audit rights to ensure quality control standards and compliance.
- Product Packaging and Display. Reseller shall sell Products in their original packaging. Relabeling, repackaging (including the separation of bundled Products or the bundling of Products), and other alterations to Products or their packaging are not permitted. Tampering with, defacing, or otherwise altering any serial number, UPC code, batch or lot code, SKU or other identifying information on Products or their packaging is prohibited. Reseller may not remove, translate, conceal or modify the contents of any label or literature on or accompanying the Products. Reseller shall not advertise, market, display, or demonstrate non-Instinct Products together with the Products in a manner that would create the impression that the non-Instinct Products are made by, endorsed by, or associated with Instinct. Reseller shall not advertise or market the Products in a way that creates a false designation of origin or false impression of affiliation with any third-party.
- Trademarks; Copyrights. Resellers that comply with this Policy have a limited, non-exclusive, non-sublicensable, revocable license to use Instinct’s trademarks and copyrights in connection with the sale of the Products. Reseller agrees that all intellectual property rights and good will shall inure to the benefit of Instinct. Reseller shall not alter, modify, conceal or change any of Reseller’s trademarks or copyrights, whether registered or unregistered, as depicted on the Products or product packaging or packaging inserts, nor shall Reseller use any of Reseller’s trademarks or copyrights, whether registered or unregistered, other than for the promotion and sale of the Products as authorized by Instinct, nor shall Reseller use any trademark or copyright in any manner that negatively impacts Instinct’s trademarks or copyrights or the Instinct. Failure to comply with the Policy will result in the automatic revocation of the license granted herein and a total forfeiture of the rights granted herein. Instinct reserves the right to revoke this license at any time for any or no reason and seek all available remedies.
- Locations / Reporting. Reseller agrees to track the Products it purchases and to store all such Products at locations in compliance with this Policy. At Instinct’s request, Reseller will provide Instinct with (a) a list of all storage locations utilized by Reseller, (b) an inventory of Products maintained at each such storage location, and (c) physical access for Instinct to perform an inventory to confirm the amounts and locations of Products at Reseller’s stated locations.
- Product Inspection. Promptly upon receipt of the Products, Reseller agrees to inspect the Products for damage, defects, evidence of tampering, or other non-conformances (a “Defect”). If any Defect is identified, Reseller must not offer the Product for sale and must promptly report the Defect to Instinct.
- Recall and Consumer Safety. To ensure the safety and well-being of the end users of the Products, Reseller agrees to cooperate with Instinct with respect to any Product recall or other consumer safety information dissemination efforts.
- Customer Service. Reseller will maintain customer service phone and email response functions to handle customer complaints, returns and other customer service functions. At Instinct’s request, Reseller will provide any reports or other information related to such customer services.
- Product Loss and Theft. If any significant quantity of Products purchased by Reseller are lost or stolen, Reseller will promptly report such event to Instinct.
- Report Unauthorized Resellers. If Reseller has information or reasonably suspects that any person is purchasing and reselling or distributing Products in a manner not authorized by Instinct or in violation of this Policy, Reseller must promptly notify Instinct.
- Support of Manufacturer’s Warranty. Reseller may extend to any proper end-user purchaser of the Products the original manufacturer’s warranty in accordance with its terms. Reseller may not modify or alter the original manufacturer’s warranty, represent or characterize the original manufacturer’s warranty in any misleading manner, or extend its own warranty with respect to the Products. Failure to comply with this Policy will result in the total forfeiture of Reseller’s right to offer Instinct’s consumer warranty.
- Other Information, Documents and Reports. Reseller must provide Instinct with any supplemental information, documents and reports that Instinct may request in order to validate Reseller’s compliance with this Policy and to support Instinct’s warranty support and customer support obligations and initiatives.
RESELLERS WHO FAIL TO COMPLY WITH THE FOREGOING TERMS FORFEIT THE RIGHT TO SELL THE PRODUCTS.
